Employed by God!

Many national newspapers have recently (and somewhat inaccurately) reported on the case of a vicar who sued his employer for unfair dismissal by saying that he could not bring a claim for unfair dismissal as he was employed by God!

Reverend Mark Sharpe worked for the Diocese of Worcester and claimed that a four year 'hate campaign' was waged against him. During his incumbency, his mail was tampered with, his dog was poisoned and his car tyres were slashed. Revd Sharpe left the role in 2009 and made a claim for unfair dismissal against the Bishop of Worcester.

The case went to the Court of Appeal and the Court held that the Revd Sharpe's claim for unfair dismissal was not well founded because, as a vicar, he was 'neither a party to a contract of employment, nor a worker' and therefore not entitled to bring a case.

There is no doubt that many of the events that occurred were very distressing and Revd Sharpe argued that the Diocese should have brought any problems within the Parish to his attention before he took up his ministry.

Revd Sharpe was represented by his Trade Union, Unite who reported that they were 'deeply disappointed' by the decision.

The Church of England is at pains to point out that 'the clergy who have ministered in these churches both before and since Mr Sharpe's appointment have all spoken very warmly of the people there and their experience doesn't reflect any of the negativity that Mr Sharpe claims to have faced.'

As is often the case, employment law disputes are often complex and rarely clear cut.
